A man from New Mexico was sentenced Tuesday morning to 90 days in jail and six years probation for rape.

Bryan Bunion, 26, previously pleaded guilty to raping a woman in September 2013 after she lost consciousness at a party in Durango.

Judge William Herringer previously rejected Bunion’s plea agreement Sept. 26. The judge said, at the time, he felt inclined to sentence Bunion to prison because he did not feel Bunion had taken responsibility for his crime. Bunion told the court that day he could not remember the incident because he was too drunk at the time.

Bunion was granted a second chance to express his feelings about the crime at the Tuesday morning hearing.

Assistant District Attorney Christian Champagne said he did express remorse and empathy for the victim.

At the hearing, Herringer also ordered Bunion to register as a sex offender and attend therapy.

The judge chose not to sentence Bunion to prison because therapy would further his rehabilitation more, Champagne said.

Herringer told Bunion during the hearing that he would not forget what a difficult choice he faced in Bunion’s sentencing.

“I will be very hesitant to afford you much leniency in the future,” Herringer said.
