Sex offender pleads guilty

A Bayfield man admitted guilt in a plea agreement to four charges in a sexual assault case Thursday, just before he was arrested again to await more possible charges.

Bryan Tyner, 39, agreed to nine years in prison and 12 years probation. If he violates his probation, he could face 12 more years.

He pleaded guilty to two felony charges of attempted sex assault on a child by a person in a position of trust. He also pleaded guilty to conspiracy to commit tampering with a witness and tampering with a witness or victim.

Tyner was arrested in March 2014 when one of his victims came forward after years of sexual abuse.

He was charged with sexually assaulting two minors.

He confessed to committing sexual acts on the victims and forcing them to perform sexual acts on him before he was arrested in March 2014, according to the arrest affidavit.

Tyner was facing nine charges, including two charges of aggravated incest. However, if the plea is accepted, five of the charges will be dismissed, said Assistant District Attorney Christian Champagne.

Judge Suzanne Carlson of the 6th Judicial District set his sentencing for Oct. 19 , at which point she could accept or reject the plea agreement.

She also ordered that he be taken back to jail, despite his public defenders’ protests.

Carlson said she was sending him back to jail because the potential for new charges being filed was cause for concern.

Tyner had been released on bond and did not expect to be taken back to jail if he pleaded guilty, said public defender Zac Brown.

However, Carlson said that his release was not part of his formal plea agreement.

“Folks only have the right to bond prior to the entry of a plea,” she said.

She said she would let defense attorneys file a motion for Tyner’s release if they wished.
