Police: Man arrested in BB gun shooting over drug deal

A Durango man has been arrested on suspicion of felony menacing for allegedly shooting a BB gun at another man’s vehicle in an apparent drug deal gone bad.

Dylan Cody Beltran, 26, was being held Tuesday at the La Plata County Jail on $5,000, according to a news release issued by the Durango Police Department.

The incident occurred about 11:15 a.m. Tuesday at Animas Park for Mobile Homes, 288 Animas View Dr. in north Durango.

Beltran allegedly shot the carbon dioxide-powered handgun at the front and rear passenger-side windows of a gold 2004 Chevrolet Tahoe being driven by Thomas Kiolbasa, 34, of Durango, according to the release.

The two were apparently arguing over $100 that Kiolbasa gave to Beltran for marijuana, but Beltran had not delivered any marijuana, according to the release.

Kiolbasa went to Beltran’s home to get his money back, but Beltran didn’t answer the door, so Kiolbasa texted him to say he was going to take a bike from the front porch, police said.

Kiolbasa didn’t take the bike, but instead returned to his vehicle to leave. At that time, Beltran emerged from his home with a black handgun and shot at Kiolbasa’s vehicle as he left. Kiolbasa believed the gun to be a small-caliber handgun, the release said.

The gunfire shattered the front passenger-side window of the Tahoe, and a small dent consistent with a BB strike was found in the rear passenger-side quarter panel, according to the news release.
