Tyree Ogsbury-Jones pleads guilty in Iron Horse Inn shooting

Plea deal would come with 30-35 years in prison

A former Fort Lewis College football player who shot two people, killing one, faces at least 30 years in prison after pleading guilty Thursday to second-degree murder and felony burglary.

Tyree Ogsbury-Jones, 23, signed a plea agreement with the 6th Judicial District Attorney’s Office in La Plata County.

According to terms of the agreement, Ogsbury-Jones faces 20 years in prison for murder and 10 to 15 years for burglary. The two charges must be served consecutively, meaning he is facing a minimum of 30 years in prison and a maximum of 35 years if District Judge Suzanne Carlson accepts the deal.

According to court records, Ogsbury-Jones and Aaron Williams, also a former FLC football player, broke into a condominium at the Iron Horse Inn to retrieve marijuana plants they said were stolen.

Once inside, Ogsbury-Jones shot Keith Moore and Daniel Johnson.

Moore survived his injuries, but Johnson, 50, died at Mercy Regional Medical Center.

Both Ogsbury-Jones and Williams fled the scene, but they were captured later that day.

Williams was sentenced to 13 years in prison earlier this year for his role in the shooting and burglary.

Ogsbury-Jones appeared reluctant to enter into a plea agreement.

He took at least 30 seconds to answer a routine “yes” or “no” question about whether he had spoken with his attorney and was satisfied with his advice before finally answering, “yes.”

He did the same when asked if entering the plea agreement is what he wanted to do.

He also needed time to speak with his public defender, John Moran, when asked how he wanted to plead to second-degree murder.

Sentencing is scheduled for 9 a.m. Aug. 31.
