BEFORE THE CITY OF DURANGO CITY COUNCIL
HORSE GULCH ANNEXATION
NOTICE IS HEREBY GIVEN that in response to a request by the City of Durango and La Plata County for annexation into the City an area of land comprised of approximately 1,149.8 acres known as Horse Gulch. The Durango City Council voted 4:0 to adopt the following Resolution at its regular meeting of February 4, 2014.
RESOLUTION NO. R-2014-5
A RESOLUTION ACCEPTING A PETITION FOR ANNEXATION AND INITIAL ZONING OF THE HORSE GULCH ADDITION TO THE CITY OF DURANGO AND SETTING A PUBLIC HEARING FOR MARCH 18, 2014.
WHEREAS, the owners of 100% of the territories described on Exhibit "A" attached hereto have filed two Petitions with the City Council of the City of Durango requesting that the Council accept said Petitions and by ordinance approve the annexation of said property which is situate, lying and being in the County of La Plata, State of Colorado, to be known as the Horse Gulch Addition to the City of Durango; and
WHEREAS, the Petitions are accompanied by a map of the territory to be annexed and the relationship of its boundaries to the established corporate limits of the City of Durango; and
WHEREAS, a request for an initial zoning of PB (Public) for the 11 properties commonly known as the Horse Gulch area, for approximately 1,149.8 acres is being processed concurrently with the annexation request; and
WHEREAS, the territory is eligible for annexation to the City of Durango under the laws of the State of Colorado, and the Petitions and the documents thereto attached meet the requirements of the statutes of the State of Colorado; and
WHEREAS, the City finds substantial compliance with said State statutes in that the territory to be annexed is specifically greater than one-sixth contiguous to existing corporate limits, has a community of interest with the City of Durango, is urban or will be urbanized in the near future, and is integrated or capable of being integrated with the City of Durango; and
WHEREAS, the proposed annexation will not extend Durango's municipal boundary more than three miles in any direction from any point of such municipal boundary in any one year;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Durango, in regular meeting assembled, that:
said petitions are hereby accepted and that a public hearing on the annexation and initial zoning be legally noticed in accordance with State statutes for 6:30 p.m. on the 18th day of March, 2014, at the Council Chambers, Durango City Hall, 949 East 2nd Avenue, Durango, Colorado, 81301.

NOTICE IS FURTHER GIVEN that the applicants are requesting an initial zoning designation of PB-Public, and that La Plata County has a 1/3 undivided ownership interest in one 240 acre parcel within the proposed annexation.
THE PUBLIC IS INVITED to attend this hearing and to present written and/or oral comments. Written comments from those who cannot attend but want their opinions considered in Council's deliberations must be received by 10:00 a.m. on Monday, March 17, in the City Clerk's office, 949 Second Avenue, Durango, CO 81301. Applications for three (3) positions on the Board of Directors of the Animas - La Plata Water Conservancy District will be accepted until Monday, March 24 (30 days after initial notice was made). Two positions are from Subdivision 3 and one position is from Subdivision 1.

One (1) original and Two (2) complete copies of the sealed bid, clearly marked "2014 Heavy Duty Truck Tractors" will be received by the administrative staff of the La Plata County Procurement Division, 235 Bodo Drive, Durango, Colorado 81303 until 2:30 PM Thursday, March 27, 2014. Bidders may, but shall not be required to, attend the award of bid and may be heard on said award if they so desire.
