NOTICE IS HEREBY GIVEN that the City of Durango City Council will consider this item on Tuesday, July 21, 2026, at 5:00 PM. The meeting will be held at City Hall at 949 E. 2nd Ave with an option to attend virtually via Teams. All persons may appear at the hearing and present written and/or oral testimony regarding this proposal. Please visit www.durangoco.gov/meetings for the link to the virtual meeting.

The purpose of this meeting is to consider the Homestead Subdivision Preliminary Plan request (Project File: PR-26-23). The proposal is for a subdivision to develop 17 townhome units at 1720 CR 240. The proposed 17 units will be a mix of 2- and 3-bedroom units. The Conceptual Development Plan for this project was approved by the Community Development Commission on October 27, 2025. This Preliminary Development Plan is the next review step. City Council will review this request for conformance with the Land Use and Development Code. Division 6-3-6 of the Land Use and Development Code outlines the criteria for Preliminary Subdivisions.

ORDINANCE NO. O-2026-______

AN ORDINANCE APPROVING THE ANNEXATION AND INITIAL ZONING FOR THE VERO RIDGE ADDITION TO THE CITY OF DURANGO AND DECLARING AN EFFECTIVE DATE.

WHEREAS, there has heretofore been filed, Petitions for Annexation to the City of Durango, for parcels of land, approximately 28 acres, as further described herein, to be known as the VERO RIDGE ADDITION, located at 455, 541, and 589 High Llama Lane, to the City of Durango; and
WHEREAS, said Petitions are signed by the current owners of one hundred percent (100%) of the property proposed to be annexed; and
WHEREAS, the Petitions for Annexation were accompanied by the required map of said tract of land; and
WHEREAS, the City Council by resolution, did accept said Petitions and has found and determined that the subject property is eligible for annexation and that the Petitions for Annexation meets the statutory requirements for annexation; and
WHEREAS, a public hearing was held before the City Council of the City of Durango on July 7, 2026. The Council has determined, subsequent to said public hearing, that the annexation of the properties commonly known as 455, 541, and 589 High Llama Lane is in the best interests of the citizens of the City of Durango;
NOW, THEREFORE, THE CITY OF DURANGO HEREBY ORDAINS:
Section 1. Subject to and conditioned on the execution and recording of a satisfactory Annexation Agreement and Annexation Plat, the annexation of certain territory to be known as the Vero Ridge Addition to the City of Durango, which territory is legally described on Exhibit ‘A’ and as shown on Exhibit ‘B’ hereto attached, the contents of which are incorporated by reference herein, is hereby approved.
Section 2. The annexation of such territory to the City of Durango shall be complete and such territory shall become a part of the City of Durango following the effective date of this ordinance but not until the completion and recording of the Annexation Agreement and Annexation Plat for the property.
Section 3. The Property, as described on the attached Exhibit ‘A’, shall be zoned Residential Medium (RM), as more fully described in the City’s Land Use and Development Code.
Section 4. This ordinance shall become effective ten (10) days after its passage and final publication as provided by law.

WHEREAS, said Petition is signed by the owner of one hundred percent (100%) of the property proposed to be annexed; and
WHEREAS, the Petition for Annexation was accompanied by the required map of said tract of land; and
WHEREAS, the City Council by resolution, has previously found and determined that the subject property is eligible for annexation and that the Petition for Annexation meets the statutory requirements for annexation; and
WHEREAS, the City Council, by resolution, did accept said Petition; and
WHEREAS, a public hearing was held before the City Council of the City of Durango on July 7, 2026. The Council has determined, subsequent to said public hearing, that the annexation of the properties commonly known as 29026 and 29064 Highway 160 is in the best interests of the citizens of the City of Durango;

NOW, THEREFORE, THE CITY OF DURANGO HEREBY ORDAINS:
Section 1. Subject to and conditioned on the execution and recording of a satisfactory Annexation Agreement and Annexation Plat, the annexation of certain territory to be known as Intersection of Three Springs Boulevard and US. Highway 160 Annexation to the City of Durango, which territory is legally described on Exhibit ‘A’ and as shown on Exhibit ‘B’ hereto attached, the contents of which are incorporated by reference herein, is hereby approved.
Section 2. The annexation of such territory to the City of Durango shall be complete and such territory shall become a part of the City of Durango following the effective date of this ordinance but not until the completion and recording of the Annexation Agreement and Annexation Plat for the property. The Property, as described on the attached Exhibit ‘A’, shall be zoned Commercial General (CG), as more fully described in the City’s Land Use and Development Code.
Section 3. This ordinance shall become effective ten (10) days after its passage and final publication as provided by law.

ORDINANCE O-2026-XX

AN ORDINANCE AMENDING, IN PERTINENT PART, THE DURANGO CODE OF ORDINANCES CHAPTER 4 - ANIMALS - ARTICLE V - IMPOUNDMENT - SECTION 4-97 – Disposition of Impounded Animals, TO READ AS FOLLOWS:

Sec. 4-97. - Disposition of impounded animals.
As soon as practicable after impoundment, notice of impoundment shall be given to the owner if the owner is known or can be located. Any impounded animal shall be released to the owner upon payment of the impoundment fee, care and feeding charges, veterinarian charges, and such other costs as may have been incurred; provided, however, in addition to the payment of the foregoing fees, costs and expenses, no impounded dog shall be released until a license has been issued for such dog pursuant to the terms and provisions of this chapter or, alternatively, until the owner of said dog has been issued a citation or a summons and complaint for failure to license said animal in accordance with the requirements of this chapter.
If an impounded animal is not redeemed within four (4) days after impoundment and during which the impounding facility is open to the public, the impounded animal shall be considered abandoned and may be placed for adoption or humanely euthanized at the discretion of the La Plata County Humane Society.
For animals impounded pursuant to Section 4-14, the four-day redemption period begins upon the court’s final disposition of the matter following the hearing required under Section 4-99, provided the court orders the animal released from impoundment.
WHEREAS, City of Durango Municipal Code of Ordinances (MCO) sec. 4-97 currently requires animals to be redeemed within four (4) days after impoundment; and
WHEREAS, the City wishes to amend this provision to clarify that the four (4) day redemption period does not begin until final disposition of the matter; and
WHEREAS, the City determines that this amendment is in the best interest of the public and use of City resources.
