Ignacio trustees fast-track Family Dollar project

Town approves development agreement, preliminary plat

Ignacio town trustees have approved the development agreement and preliminary plat for owner Richard Olguin's Rock Creek Complex commercial development at the south end of town, with the intent that a Family Dollar store will be built there this fall.

Trustees approved the first steps in the land use permit process on Aug. 19. Olguin wants to subdivide the 7.29 acre parcel, the old Williams Field Service property, into three lots. The Family Dollar will be built on the center lot, of 0.824 acres.

According to the agreement, development work was to start around Aug. 15 and be completed by Dec. 15.

The development agreement calls for Olguin to bring water, sewer and gas lines from across Highway 172 to serve all three lots. Those are off-site public improvements that must meet town, tribe, and state standards. Olguin will construct the access, which requires a Colorado Department of Transportation access permit and utility installation permit as a pre-condition to development.

The agreement calls for a two-year warranty on all public improvements. Once accepted by the town, they will become town property.

On-site private improvements include earthwork, utilities, lighting, building construction, roads and parking, landscaping, and storm drainage. The agreement does not include any variance or exception from Town Code requirements. The agreement requires Olguin to connect the 8-inch water line on the property to the existing town line on El Paso Street to loop the town system.

Olguin is required to post a performance bond or other assurance equal to 110 percent of the estimated cost of improvements. All tap and other fees must be paid before work starts.

"I haven't issued permits for any utility installations yet. I'm asking approval of this so we can move forward," Town Development Coordinator Dan Naiman told trustees on the 19th. "Everything seems to be pretty much in order."

Family Dollar wanted a fast-track approval process, according to discussion at previous town board meetings. But because of a requirement to advertise the public hearing at least 30 days in advance, the hearing was set for Oct. 7. "That will be about the time I present the final plat to the board," Naiman said.

Trustees approved the development agreement and preliminary plat with minimal discussion.
