Through its insurance company, the city of Durango will pay $10,000 to settle a lawsuit filed by a woman who was injured by a piece of art that fell on her in August 2013 at the Durango Community Recreation Center.
According to the settlement agreement, Shaohong Deng of Durango and her attorney will receive $6,966.68. The woman’s health provider will receive $3,033.32.
Her attorney, Kirk Carroll of Durango, declined to comment.
The city provided a copy of the settlement this week after receiving an open-records request from The Durango Herald. The case was settled in November and formally dismissed Dec. 29 in 6th Judicial District Court.
According to the lawsuit, Deng was watching her child on the climbing wall at the rec center when a piece of art that resembled a kite fell from the ceiling and struck Deng on the head.
A piece of fabric wrapped around her head and jerked it forward, according to the civil complaint. She suffered injuries to her right shoulder, neck and left ankle in the Aug. 31, 2013, incident.
The artwork has since been removed.
