Suspect’s hearing put off one week

Prosecution, defense to work on an agreement

An Ignacio man suspected of beating his stepfather to death with a 35-pound propane tank was in 6th Judicial District Court for a motions hearing Monday.

But prosecution and defense are close enough to an agreement on issues that Judge Jeffrey Wilson scheduled a disposition hearing for 9 a.m. Monday.

Assistant District Attorney Christian Champagne is the prosecutor. Justin Bogan from the public defender’s office represents Silva.

If no agreement is reached by Monday, the court can resume the motions hearing, Champagne said.

Silva is suspected of assaulting his stepfather, Clayborn Scott, 55, on May 8, 2012, in the house they shared four miles north of Ignacio and three miles east of Oxford.

He is charged with second-degree murder.

Silva, 32, pleaded not guilty by reason of insanity and was deemed incompetent to stand trial by Wilson in January 2013 based on an evaluation done at the Colorado Mental Health Institute in Pueblo.

Silva was kept in jail, where he received a regimen of medications that stabilized him. In July 2013, Wilson found Silva had been restored to sanity, meaning he could stand trial.

In August 2013, Silva again pleaded not guilty by reason of insanity.
