AN ORDINANCE AMENDING, IN PERTINENT PART, THE DURANGO CODE OF ORDINANCES, CHAPTER 23 – TAXATION – ARTICLE II – SALES AND USE TAX – SECTION 23-73 - Open space, parks and trails fund; restricted capital improvements fund – TO READ AS FOLLOWS:

Sec. 23-73. - Open space, parks and trails fund; restricted capital improvements fund.
(a) Fund for open space, parks and trails created. There is hereby established a segregated fund of the city to be known as the "open space, parks and trails fund." From and after July 1, 2005, immediately upon receipt or collection thereof, a sum equal to fifty (50) percent of the increased tax revenues received by the city from collection of city's sales tax and use tax imposed by Chapter 23 of the Code of Ordinances of the City of Durango, and resulting from the increase in the sales and use tax rate from two and one-half (2½) percent to three (3) percent approved by the registered voters of the city effective July 1, 2005, shall be credited to said fund.
(b) Use of funds restricted (open space, parks and trails fund). In accordance with the original ballot measure approved by the registered electors of the city on April 5, 2005, and extended by voter approval on April 1, 2025 as authorized by the corresponding ballot measure, funds deposited into the open space, parks and trails fund shall be expended solely to finance the acquisition and maintenance of land parcels for the purpose of public parks, open space preservation, natural resources protection, and recreational pursuits, including but not limited to such projects as the Animas River Trail and soft surface trail system expansion and ongoing facilitation of the Animas River Corridor Management Plan; and other projects prioritized by the Parks, Open Space, Trails, and Recreation Master plan, such as development of dedicated parkland, trails and amenities within Durango Mesa Park area. the preservation, acquisition, and maintenance of natural lands, including, but not limited to, land to preserve water quality in rivers and streams, wildlife habitat, land for hiking and biking, and the creation and maintenance of parks and trails. All program expenditures from this fund shall be authorized by the city council after review and consideration of recommendations of a citizen advisory board appointed by the council.
(c) Fund for capital improvements created. There is hereby established a segregated fund of the city to be known as the "restricted capital improvements fund" from and after July 1, 2005, immediately upon receipt or collection thereof, a sum equal to fifty (50) percent of the increased tax revenues received by the city from collection of city's sales tax and use tax imposed by Chapter 23 of the Code of Ordinances of the City of Durango, and resulting from the increase in the sales and use tax rate from two and one-half (2½) percent to three (3) percent approved by the registered voters of the city effective July 1, 2005, and extended by voters on April 1, 2025, shall be credited to said fund.
(d) Use of funds restricted (restricted capital improvements fund). In accordance with the ballot measure approved by the registered electors of the city on April 5, 2005, and extended on April 1, 2025, funds deposited into the restricted capital improvements fund shall be expended solely for capital improvements, including, but not limited to, a new library and road, sidewalk and associated improvements to enhance driver, pedestrian and bicycle safety. the payment of the debt authorized by the April 1, 2025 ballot provision which increased the City of Durango’s debt to $61 million, with a repayment cost of $123 million for the purpose of financing the restoration and equipping of the historic Durango High School building and adjacent facilities for use as a new City Hall and new police facility. These funds may also be used to pay the cost of the issuance of such debt and the funding of any necessary reserves. The specific terms of such debt shall be determined by the City as necessary and prudent, including the pledge of any legally available revenue of the City revenue for its repayment, and may include a provision for early repayment with or without premium of not more than 3%. The ballot provision also authorized the City to issue debt to refund the debt, provided that all debt issued by the City pursuant to the ballot provision is issued on terms that do not exceed the repayment costs authorized in the ballot provision. The earnings from the investment of such bond proceeds may be collected, retained, and spent as a voter-approved revenue change under Article X, Section 20 of the Colorado Constitution and any other applicable revenue limitations under state law.
(e) Funds not to be pledged or expended for general purposes. Monies credited to the open space, parks and trails fund or credited to the restricted capital improvements fund shall not be available to be pledged or expended for any general purposes of the city.
(f) Termination date of sales and use tax increase. The increase in the sales and use tax rate from two and one-half (2½) percent to three (3) percent, approved by the registered voters of the city at the general municipal election of April 5, 2005, and effective July 1, 2005, extended by voter approval on April 1, 2025, shall terminate December 31, 20256.
WHEREAS, the eligible electors of the City of Durango approved a ballot issue at the general municipal election on April 1, 2025, wherein the electors approved an extension of the expiration date of the 2005 one-half cent sales tax; and
WHEREAS, Section 23-73 of the City Code was adopted to create two segregated special funds – namely, the “Open Space, Parks and Trails Fund” and the “Restricted Capital Improvements Fund” to administer the sales tax revenues generated by the 2005 increased one-half cent sales tax; and
WHEREAS, the language of Section 23-73 should be amended to align with the provisions of the 2025 ballot question, including the revised expiration date of the tax and the updated authorized uses for the extended tax; and
WHEREAS, amending the language of Section 23-73 of the Code to reflect the language and intent of the 2025 ballot question would be in the best interests of the citizens of the City of Durango.
NOW THEREFORE THE CITY OF DURANGO HEREBY ORDAINS THAT THE DURANGO CODE OF ORDINANCES, CHAPTER 23 – TAXATION – ARTICLE II – SALES AND USE TAX SECTION 23-73 – Open space, parks and trails fund; restricted capital improvements fund, BE AMENDED TO READ AS FOLLOWS:

ORDINANCE NO. O-2025-

AN ORDINANCE REPEALING, IN PERTINENT PART, THE DURANGO CODE OF ORDINANCES, CHAPTER 8 - FIRE PREVENTION AND PROTECTION - ARTICLE V - DURANGO FIRE PROTECTION DISTRICT IMPACT FEES AND DECLARING AN EFFECTIVE DATE

Sec. 8-71. - Impact fee adopted.

The city hereby adopts the Durango Fire Protection Impact Fee (DFPD impact fee), subject to the terms, conditions and limitations further set forth herein. The adoption of the DFPD impact fee is based on evidence provided by the DFPD Impact Fee Study which quantifies the reasonable impacts of new development and proposes a fee no greater than necessary to defray the costs of providing funding for future capital improvements needed by DFPD to adequately provide fire and emergency services to new growth and development in areas within the jurisdiction of the city, and which is not imposed to remedy any deficiency in capital facilities that exist without regard to any such proposed development.

Sec. 8-72. - Amount of fee.

The DFPD impact fee shall be set at the following amounts:

(a) For residential development, the DFPD impact fee shall be one thousand three hundred seventeen dollars ($1,317.00) per unit.
(b) For commercial or other non-residential development, the DFPD impact fee shall be two dollars and three cents ($2.32) per square foot of enclosed floor area.
(c) In cases where a residential use of property is approved to be converted to a non-residential use, then the DFPD impact fee shall be the amount of the commercial impact fee for the new commercial use, less a credit in the amount of the residential impact fee.

Sec. 8-73. - Applicability.

The DFPD impact fee shall apply to any new residential or commercial development that requires the issuance of a building permit by the City under any City Code, regulation, resolution or agreement, except no fee shall be applicable to the following:

(a) Any development for which a building permit application was submitted and accepted as being complete by the city prior to the effective date of this article.
(b) The remodel, replacement or enlargement of any residential unit.
(c) The remodel or replacement of any non-residential property that does not result in an increase in square footage. In the event there is an increase in square footage of any non-residential property, then the impact fee shall apply only to that increase in square footage.
(d) Any development that has paid a fire impact fee pursuant to a development agreement or other contract, including, but not limited to, development within Three Springs and Twin Buttes as long as the existing fire impact fees are in effect.
(e) For the development of an accessory dwelling unit as defined in the city's Land Use Code.
(f) For development that will provide low or moderate income housing or affordable employee housing pursuant to guidelines established by the City.
(g) For any development that is otherwise required by agreement to provide any site specific dedication or improvement to meet the same need for capital facilities for which the DFPD impact fee is imposed. The value of any such dedication shall be treated as a credit against any fee otherwise due in an amount not to exceed the DFPD impact fee for that development.

Sec. 8-74. - Collection of fee.

(a) The DFPD impact fee due under the provisions of this chapter shall be paid in full prior to the issuance of a city building permit for that development.
(b) The payment of the DFPD impact fee shall be made by the person seeking a city building permit directly to DFPD, and DFPD shall provide a receipt to that person for such payment. The city shall be entitled to rely on a written receipt from DFPD as evidence of payment of all fees.
(c) In the event a building permit is issued for a development that has not paid the DFPD impact fee, then the payment of such fee shall be made as soon as possible after notice of the deficiency. The city shall be entitled to issue stop work orders or to withhold any further approvals for the development, including, but not limited to, certificates of occupancy until all fees are paid.
(d) It shall be the obligation of DFPD to collect, account for and apply the DFPD impact fees provided for herein as required by state law, the City Code and the IGA entered between the parties pursuant to this article.

WHEREAS, the City of Durango previously adopted Article V of Chapter 8 of the Durango Code to impose fire impact fees on behalf of the Durango Fire Protection District ("DFPD") for the purpose of funding fire and emergency services necessitated by new development, as originally authorized by C.R.S. § 29-20-104.5; and

WHEREAS, the City of Durango is excluded from the jurisdictional boundaries of the DFPD, as established by the “Petition for Exclusion” referenced in the 2014 agreement between the City and the DFPD; and

WHEREAS, because of this exclusion, the City retains full authority under state law to impose or negotiate fire impact fees within its municipal boundaries; however, Senate Bill 24-194 (SB-194), enacted in 2024, authorizes fire protection districts to independently impose and collect fire impact fees for new development within their jurisdiction, pursuant to a legislatively adopted fee schedule; and

WHEREAS, under SB-194, the DFPD is now empowered to directly impose and collect its own impact fees within its jurisdiction, allowing for a simplified and district-driven approach to funding fire and emergency services in areas it serves; and

WHEREAS, while the City retains the authority to negotiate or impose fire impact fees within its jurisdiction, the City Council finds that the continued inclusion of Article V of Chapter 8 is no longer necessary at this time and that its repeal will reduce administrative redundancy and promote clarity.

NOW THEREFORE THE CITY OF DURANGO HEREBY ORDAINS THAT THE DURANGO CODE OF ORDINANCES, CHAPTER 8 – FIRE PREVENTION AND PROTECTION – ARTICLE V – DURANGO FIRE PROTECTION DISTRICT IMPACT FEES, BE AMENDED TO READ AS FOLLOWS:

Rockridge Pump Station Replacement

Sealed bids for the Rockridge Pump Station Replacement project will be received by the City of Durango until 3:00 PM (Local Time) on August 11th, 2025. The City of Durango invites interested, qualified persons or firms, capable of providing the required service to submit bids for improvements that generally consist of furnishing and installing a factory-built booster pump station, salvage of the existing factory pump station for future City use, furnishing and installing a backup generator, installing new pipelines with connections to the pump station and the existing waterlines, installation of two (2) gate valves, abandonment of the existing pipelines, installation of security fencing, extending and installing communication and electrical conduits, installing an electrical panel array, and restoring existing surface conditions. The pump station can only be shut down for a maximum of 5 hours during the switch from the existing pump station to the new pump station.

There will be a non-mandatory pre-bid conference at 1:00 p.m. (Local Time - MST) on Tuesday, July 15th, 2025, at the Project Site located near 2614 Borrego Dr, Durango, CO 81301, to familiarize bidders with the project.
