Over the years, the DOJ has expanded to include the FBI, DEA, ATF, U.S. Marshals Service, Bureau of Prisons and Department of National Security as well as the attorneys for civil, criminal, environmental, tax, immigration and internal misconduct.
This is all headed by the attorney general appointed by and reporting to the president. Why would the founding fathers put the fox in charge of the hen house? They did not!
This arrangement has created the stage for a dictatorial takeover of our democracy. The DOJ was created by a law passed by congress in 1870. In that the current DOJ arrangement was created by a congressional law, it can also be changed by a congressional law. Currently, the Judicial Department has no teeth or enforcement ability. This can be changed by removing the DOJ from under the president’s control and locating it under the Judicial Department.
Instead of the attorney general being appointed by the president, they could be elected by a two-thirds majority of the approximately 880 federal judges. These judges have lifetime appointments, but because there are so many of them, it would be much less likely that the attorney general would be a political appointee doing the bidding of the president. The DOJ can be removed from under presidential control in the 2026 midterm elections. About one-sixth of the House and Senate seats need to be flipped to Democratic to have enough votes to change the DOJ law and override the certain presidential veto.
