Proposed storage business raises concerns

Bayfield trustees to consider moratorium

Storage units and a metal shipping container lot in the middle of the Bayfield Center Business Park?

Maybe not. Town Manager Chris La May advised trustees of that pending proposal Tuesday night. It would be across Bayfield Center Drive from the First National Bank, he said.

"A few people came to talk to me about, are those really good uses in the business center, but the way the (land use) code is written, those are allowed," he said, adding that the town "hasn't taken a strong stand" on things like architectural standards. "Do you want me to?"

Trustee Kristin Dallison and Mayor Matt Salka said yes. Salka said, "A storage place, I see other uses there." He asked when allowed uses were last reviewed.

"Before my time," La May said. He started with the town in summer 2011.

"We want to be open to business, but we don't want to detract...," he said and suggested the town planning commission should look at the desired uses within a business zone.

Trustee Matt Nyberg asked, "What legal stance do we have to deny it?"

Salka said, "The way it's set now, they can come in and start building without going to the planning commission."

La May advised there'd been no formal development submittal. "We could do a moratorium until you have the time to do regulations that you prefer."

Town attorney Jeff Robbins advised that the length of a moratorium "has to be reasonably related to the time it will take to do the review. Anything over six months starts to be suspect. But it's a planning tool when there's development pressure. It's not to be taken lightly, because of the message it sends. What I'm hearing is a limited look at what are uses by right in the business district."

He suggested a three-month moratorium that could be extended if needed. He suggested a special meeting this same week to do that.

Trustees set it for 6 p.m. Thursday, Feb. 9.
