Sapharino Joseph Torivio, 31 – who is serving an eight-year probation and had been sentenced to six years in prison for sexual assault – recently moved to Durango.
He pleaded guilty in 2009 to sexual assault of a 15-year-old victim incapable of appraising the situation and felony contributing to the delinquency of a minor.
He is living at the Spanish Trails Inn & Suites.
Based on a psychological evaluation that was conducted as part of his sentencing, regardless of charges, Torivio is considered a sexually violent predator, and local law-enforcement agencies are required to notify the surrounding residents of his arrival.
In Colorado, there are 16,684 registered sexual offenders – 164 live in La Plata County – and four of them have been concluded to be sexually violent predators.
Torivio is required to check in and update his probation officer every three months and attend sex-offender treatment classes.
His case manager, La Plata County Sheriff’s Deputy Seuss Beyer, said Torivio received an early release in August 2013, likely based on good behavior.
Beyer, who keeps a free, up-to-date website on locations of all registered sex offenders, said it’s more practical to know the whereabouts of sex offenders instead of alienating them.
Torivio is requesting that his probation be transferred to Utah.
