The Durango School District 9-R/Durango Fire Protection District contract for the 9-R Administration Building reserves to DFPD the right to exit the contract if it determines the deal not to be in the best interests of the community.
The strategy of DFPD in withholding a plan until after the purchase has the intended effect of eliminating engagement of the general public, thereby preventing any good faith determination of the best interests of the community.
DFPD is intentionally not publishing a plan to the city. The city keeps saying, where there is “no plan,” there is “no review” and thus “no comment.” Where a strategy is designed to silence the general public, the designer of that strategy assumes the duty of engagement of the general public to determine its best interests. Where that duty is resisted there can be no claim of good faith.
