Will farming be prevented under code?

If you like the semi-rural mixed character of the Animas Valley, or live there, please comment on the draft county land-use code, which seems to want to discourage or prevent agricultural activities on the numerous small lots in the valley.

Nearly all the small lots along County Road 203 on the west side of the valley, and along CR 250 along the east side of the valley – that are currently zoned as single family residential – are in line to be zoned “Semi-Urban Residential,” where growing, storing, and selling vegetables may not be permitted, or “Suburban Residential,” on which growing, storing, and selling vegetables would require a special-use permit.

Currently growing, storing, and selling vegetables in these areas is a “use by right” that requires no permit. You may be able to grow for your own use, but may not be able to sell at a fruit or vegetable stand on your property or anywhere else, or have a nursery, grow trees for sale etc. unless you are specifically grandfathered in (Table 63-2-2).

In addition, most of this area would be within a river/scenic overlay zone that could constrain agricultural activities or add costs.

There are many people in the Animas Valley who are contributing to the local food movement whose current activities will potentially be constrained by the new code, yet the plan ironically says it will encourage agriculture.

Let the county commissioners and planners know your concerns.
