At the heart of the lawsuit against TABOR is the never-ending desire of Democrats to raise taxes and this voter-approved, citizen-based initiative has long been a much-resented constraint upon them. Perhaps even more important is the chaos that would be the legal result if the Supreme Court overturned TABOR. If voter-approved, citizen-based initiatives are unconstitutional, thousands would be required to be overturned nationally. Among them is Colorado’s legalization of marijuana, which was the result of one of these citizen-based initiatives.
